High Street and online retailer GAME has promoted the new Android console with a picture of a SNES emulator as one of the "free games" available for the fledgling machine.
An emulator, which allows software from other consoles to be run on hardware it wasn't intended for, occupies a grey area of copyright law. The programs themselves don't break the law, but using them nearly always involves some degree of piracy.
The offending image has now been removed since it was first spotted by Twitter users (CVG has a picture of the original advertisement if you want to see it for yourself), but the fact a major retailer like GAME chose to promote the console with such a feature is... questionable at best.
