Valve could face a three million US dollar fine in Australia

The three year trial is almost over.

The Australian Competition and Consumer Commission (ACCC) wants Valve to pay a fine of three million US dollars "in order to achieve both specific and general deterrents, and also because of the serious nature of the conduct" between 2011 and 2014 in the case of lack of an advertised refunds policy on their site and within the Steam Subscriber Agreement.

This is all as a three year trial is ending, and the Judge Edelman will pass sentence in mid December or January 2017. Meanwhile the Australian regulator asked for a penalty of three million dollars, while the American company itself offers to pay a fine of 250,000 dollars.

Discussions will go further, however, as the justice is not sure how to enforce penal orders in a foreign jurisdiction. Valve's attorney said that they had "no instructions that Valve at this time will resist the enforcement overseas of any of your Honour's orders", according to Kotaku AU.

ACCC sued Valve for misconduct and violation of Australian consumer law within the refund policy of Steam for advertising to not give refunds as a basis, even though some customer did get their money back in different cases. The Seattle based company argued that they are an American company operating under American rules worldwide, however. What do you make of the case?
