We were a little confused over the teaser site alloutofgum.com that features a countdown to February 25. It appears to tease the announcement of Duke Nukem: Mass Destruction (PC, PS4) in development at Interceptor Entertainment (authorised by 3D Realms). Now 3D Realms sold the rights to Duke Nukem to Gearbox Software back in September 2010 and this is where it gets sticky.
Gearbox Software have now filed a lawsuit in an apparent pre-emptive strike (via Kotaku to dissuade 3D Realms and Interceptor Entertainment to move ahead with Duke Nukem: Mass Destruction (said to be a topdown action-RPG).
What's interesting is that the filing includes a letter/statement in which 3D Realms' Scott Miller and George Broussard admit they are in the wrong.
Naturally, it's hard to imagine a Duke Nukem game without any sort of controversy so we'll have to wait and see how this latest mess ends up.
