THQ Montreal has had an injunction overturned that would have prevented them from hiring staff working at Ubisoft Montreal.
Assassin's Creed creative director Patrice Désilets left Ubisoft last year to work with THQ Montreal. According to the report in CVG; Désilets had a ‘non-compete' clause in his contract, which Ubisoft thought he had broken by recommending their staff to his new employer.
At least 3 members of the Ubisoft team followed Désilets to THQ.
Ubisoft put the injunction in place in March, but the court of appeal in Quebec has since overturned to decision on the grounds that THQ was not bound to the same non-competition clause.
Ed Kaufman from THQ had this to say: "The Court of Appeal's decision is a tremendous victory for THQ Montreal and all of the creative talent working in the video game industry in Montreal. We are thrilled with the Court's decision in this matter because we believe strongly in an individual's freedom to choose where they want to be employed."
