2 Milly considering legal action over Fortnite's Milly Rock

The emote uses his popular dance.

If you're a fan of Fortnite you probably know a lot of the dances that have made their way from real life to the battle royale game, including the Milly Rock dance popularised by rapper 2 Milly, but now CBS has reported that 2 Milly has taken issue with the inclusion of his moves.

"Everybody was just like, 'Yo, your dance is in the game,'" he said. "They actually sell that particular move. It's for purchase. That's when I really was like ... oh nah, this can't go on too long."

CBS adds that 2 Milly hopes to pursue legal action against Epic Games for using the dance, although there's actually no body of case law related to dances and "choreographic works," as explained by business and entertainment lawyer Merlyne Jean-Louis. It's not even about the money for 2 Milly either, who adds: "I just feel like I have to protect what's mine."

You can no longer buy the emote (called Swipe It) but you can still use it if you own it.

This isn't even the first time that Epic has been called out over the inclusion of these dances, as Chance the Rapper tweeted back in July about the issue, saying:

"Fortnite should put the actual rap songs behind the dances that make so much money as Emotes. Black creatives created and popularized these dances but never monetized them. Imagine the money people are spending on these Emotes being shared with the artists that made them."
