Details on Bungie plans

The trial between former Infinity Ward heads Jason West and Vincent Zampella is about to start and one interesting factoid to come out of it is that Activision were forced to reveal the contents of the contract with Bungie - a deal signed as the publisher was looking to re-establish credibility following the Infinity Ward defections.

LA Times provides us with all the details on the project called "Destiny" that will see full game releases every other year starting fall 2013 with three more games planned. Subsequently an expansion is planned for the years in between. What is also interesting is the fact that the contract states that the first of these games is to be exclusive for a period of time on Xbox 360 and/or its successor (named Xbox 720 in the document), with versions for Sony's PS3 or successor, and PC arriving later. Subsequent releases are planned for simultaneous release.

No actual details on "Destiny" are part of the 27-page document although it is being referred to as "sci-fantasy, action shooter games".

We was this information released? Well, the lawyers of West and Zampella argue that the duo waived certain financial upsides to remain in control of the creative side. And with Bungie getting a rather hefty payment if "Destiny" proves a hit. Activision are paying Bungie $2.5 million a year based on met milestones in 2010-13, with an extra $2.5 million due if the game scores 90 or higher on Metacritic (see journalists have true power after all, yikes!). However, the real potential in the deal is that Bungie stand to take home between 20-35 percent of Activision's "operating income" (profit after all expenses incl. development and marketing are deducted), which if "Destiny" proves a hit could be massive amounts of money.

Anyway, it's hard to see similarities in a contract between an independent developer who owns their IP and that of two employees of Activision who own absolutely nothing of the IP. The trial is set to kick off on May 29 and will likely bring more exciting revelations along the way.
